Civil Litigation

Nelson, Connell & Slein attorneys have extensive expertise in civil litigation matters. This term is all-encompassing and includes a wide range of matters tried in civil court including, but not limited to, professional malpractice, property damage, civil rights, professional negligence, breach of contract actions, actions for injunctions, or cases in which the Court is asked to declare the rights of the parties. NCS has expertly represented businesses, individuals, insurance companies and their insureds in such matters since our founding in 1991.

Insurance Coverage and Disputes

NCS attorneys are experienced in managing insurance disputes and claims, including those involving large and high profile coverage disputes and multiple insurers as well as relatively straightforward disputes involving two parties. The firm uses a variety of approaches to resolve a dispute, including a combination of negotiation, alternative dispute resolution and litigation. Our firm utilizes a team approach and our years of experience representing insurance companies and their insureds to achieve the best results.

Personal Injury Litigation

Personal injury litigation includes a broad range of injuries and accidents including work-related injuries, auto accidents, premises liability, and products liability. The attorneys of NCS use a variety of methods, including mediation and arbitration when appropriate, to provide efficient and cost effective advocacy for our clients in all manner of personal injury litigation.

Worker's Compensation

Worker's compensation is an area of the law that affects all businesses and their employees, but is an area of practice with which many attorneys are unfamiliar.   Our firm employs attorneys who have more than 25 years experience in this forum trying cases throughout Wisconsin.  We have successfully represented employees, employers and worker's compensation insurers through the entire administrative and judicial process.  We regularly give presentations on issues and current developments associated with worker's compensation.

Professional Liability

NCS attorneys provide consultation and representation for professional liability claims, including issues of ethical and professional responsibility, legal malpractice, insurance agents and broker errors and omissions litigation, and real estate agent and broker liability. The firm's team includes attorneys with extensive experience providing outstanding representation to defend Wisconsin professionals and their insurers against liability claims.

Real Estate Agent Litigation

In many real estate transactions, buyers or lenders will allege that material facts were not disclosed prior to the sale, or that appraisers, inspectors, surveyors or title insurance agents were negligent in performing pre-sale property evaluations.  NCS attorneys have significant experience in the defense of lawsuits all over Wisconsin involving sellers and professionals involved in real estate transactions as well as handling related insurance coverage issues.

Insurance Agency Litigation

Often a policyholder who sustains a loss not covered by insurance will blame the insurance agent who procured the coverage.  These cases often involve complex insurance coverage issues.  Our attorneys have been successfully defending insurance agents and agencies in Wisconsin courts for more than 30 years.  NCS attorneys have become adept at navigating the multi-faceted insurance process from the time of purchase until the time a loss occurs.

Legal Malpractice Litigation

Legal malpractice allegations can involve allegations against attorneys working in any area of the law. Claims against lawyers often include simple negligence, gross negligence, negligence per se, breach of contract, breach of fiduciary duty, fraud, and violations of state law or local statute. Nelson, Connell, & Slein attorneys have extensive experience defending attorneys and their insurers in claims of attorney malpractice and grievances filed with the Office of Lawyer Regulation (OLR), including experience representing clients in civil courts, before OLR Referees and in the Wisconsin Supreme Court.

Construction Litigation

Contract compliance and performance, as well as claims of defective and negligent design are managed by a team of experienced attorneys who have knowledge and expertise in confronting areas of engineering and construction management that general contractors and subcontractors often face and which are involved in litigating construction disputes.

Business Entities/Corporate Law

NCS attorneys are experienced in handling a wide range of business matters from the selection and establishment of new business entities to the purchase and sale of existing businesses. Our attorneys assist their business clients with succession planning, shareholder agreements, operating agreements, covenants not to compete, conflict resolution and business litigation.

Real Estate Transactions and Litigation

NCS attorneys provide their clients with experienced representation in real estate matters including home sales and purchases, real estate development, condominium creation, construction contracts, commercial real estate, commercial and residential leases and environmental litigation. Our attorneys offer litigation experience and knowledge in this field to provide cost effective and efficient representation to clients.

Probate and Estate Planning

NCS provides a full range of estate planning and probate services, including drafting of wills and trusts and representation of the personal representative in the administration of estates. Our attorneys are experienced in handling all types and sizes of estates and trusts ranging from the simplest of wills to more complex trusts. These services help our clients minimize their tax liability and maximize their ability to efficiently transfer assets to their chosen beneficiaries.  Our attorneys also are knowledgeable in business succession planning, family wealth transfer, and preservation planning.

Mediation and Arbitration

Mediation and arbitration services are used to settle a wide variety of cases ranging from a simple premises liability complaint to complex, multi-party disputes. Mediation settles disputes for parties in conflict without engaging in court proceedings. Arbitration is less formal and costly than a traditional court trial, yet can provide a binding result following the review of testimony and evidence. When the situation warrants, NCS attorneys work to find an acceptable solution for all parties involved through voluntary or court-ordered mediation or arbitration processes.
